How it usually works
Step 1
Assessing your case
We look at the facts and documents, explain where you stand and the time limits that apply, and talk through your options.
Step 2
Letters and negotiation
We write to the other side setting out your position. Many disputes are resolved at this stage, without court.
Step 3
Mediation
Before issuing court proceedings, we are required to advise you about mediation, which can often resolve a dispute more quickly and at lower cost.
Step 4
Court proceedings
If needed, we issue proceedings in the District, Circuit or High Court, depending on the value and type of claim, and represent you through to settlement or a hearing.

Legal costs
Before any work starts, we’ll give you a written notice of our likely legal costs and any outlays, as the law requires. If anything changes along the way, we’ll tell you.
In court proceedings, the losing side is usually ordered to pay the winning side’s legal costs, but this is at the court’s discretion and may not cover all of your costs. We’ll explain the risks before you decide how to proceed.
In contentious business, a legal practitioner may not calculate fees or other charges as a percentage or proportion of any award or settlement.
Frequently asked questions
Do I have to go to court?
Not necessarily. Many disputes are resolved through letters, negotiation or mediation. Court is usually a last resort.
What is mediation?
Mediation is a voluntary process where an independent mediator helps both sides reach their own agreement. Solicitors are required to tell clients about mediation before issuing court proceedings.
Are there time limits?
Yes. Most claims must be brought within a set time, often six years for contract claims, and shorter periods apply to some types of claim. Getting advice early protects your position.
What if I lose?
You may be ordered to pay some or all of the other side’s legal costs as well as your own. We’ll talk you through the risks at each stage.
How long does it take?
It depends on the type of dispute and whether it settles. Some matters are resolved in weeks; contested court cases can take much longer.
How much will it cost?
Before we start, we’ll give you a written notice of our likely costs, as the law requires, and we’ll update you if anything changes.
